Scott Jerger, our lead environmental attorney, is recognized nationwide for his expertise on Clean Water Act issues. The experience Scott gained as an environmental attorney for the State of Texas and City of El Paso has proven invaluable to our clients.

Current environmental cases

CWA Enforcement
Field Jerger LLP assists citizens and environmental groups in enforcing the provisions of the CWA against polluters who are either violating their water quality permits or do not have a permit to discharge pollutants into the navigable waters of the United States. Scott Jerger has over 14 years experience litigating all aspects of the CWA’s National Pollutant Discharge Elimination System (“NPDES”) program, including: (1) challenging statewide general NPDES permit provisions issued by DEQ for specific sectors in state court, (2) litigating NPDES permit renewals in state administrative proceedings; and (3) suing NPDES permit holders for violations of the terms of their permits in federal court. Scott’ practice is truly nationwide having litigated CWA issues in Oregon, Texas, Washington, New Mexico, Michigan and Illinois. Scott has also written extensively, including an article in the Stanford Environmental Law Journal, on the NPDES permitting requirements for Concentrated Animal Feeding Operations.

Environmental Impact Litigation
Field Jerger’s environmental impact litigation focuses on litigating complex environmental cases in federal court against federal government agencies. Recent cases including lawsuits challenging the US Forest Service’s herbicide application program on the Wallowa-Whitman National Forest in Eastern Oregon and a challenge in the Ninth Circuit Court of Appeals to an operating permit issued by the Federal Energy Regulatory Commission to a Liquefied Natural Gas import terminal on the Columbia River.
